MoveBrush Terms and Conditions

Welcome to MoveBrush! These Terms and Conditions ("Terms") are a legal agreement between you and Easyberry LLC ("we," "us," or "our") about your use of the MoveBrush iPad application (the "App"). By downloading or using MoveBrush, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the App.

If you're under 18 (or the age of majority where you live), please have a parent or guardian review these Terms with you before using MoveBrush or making any purchases.

1. Your License to Use MoveBrush

We're granting you a personal, limited, non-exclusive, non-transferable, and revocable license to install and use MoveBrush on Apple devices you own or control. MoveBrush is licensed to you, not sold.

What you can do:

• Install MoveBrush on your own devices
• Create artwork and animations
• Use it for personal or professional creative work

What you can't do:

• Share the app over a network or with others
• Rent, lease, sell, or sublicense MoveBrush
• Reverse engineer or extract the source code (except as permitted by law)
• Modify the app or create derivative versions
• Remove our branding or proprietary notices

All rights not specifically granted to you are reserved by Easyberry LLC.

2. Intellectual Property

Our Stuff

Everything in MoveBrush—the software code, graphics, animations, logos, UI design, and documentation—is owned by Easyberry LLC or our licensors. It's all protected by copyright and other intellectual property laws.

The MoveBrush name and logo are proprietary to Easyberry LLC. Please don't use them without our permission.

Your Stuff

You own your artwork. Everything you create with MoveBrush belongs to you. We don't claim any ownership of your drawings, animations, or creative work.

However, you're responsible for making sure your creations don't violate anyone else's rights. If you use images, designs, or content from other sources in your work, make sure you have permission to use them.

3. Using MoveBrush Responsibly

MoveBrush is designed for creative expression and is appropriate for ages 5 and up. We trust you'll use it responsibly. Here's what that means:

Basic rules:

• Use the App only for lawful purposes
• Don't introduce viruses, malware, or anything harmful
• Don't try to hack, exploit, or break the App
• Respect other people's intellectual property rights

Content guidelines:

• Don't create content that's illegal or violates others' rights
• Don't create sexually explicit, violent, or hateful content
• Don't create anything that exploits or harms children

We don't monitor what you create—your artwork is private. But if prohibited content is brought to our attention, we may terminate your license and report it to authorities if required by law.

4. Premium Features & In-App Purchases

MoveBrush is free to download with optional premium features you can purchase. Here's how it works:

Making a Purchase

All purchases happen through Apple's App Store using your Apple ID. We don't handle payments or store your payment information—Apple does that.

When you buy premium features, you're purchasing a license to use those features within MoveBrush.

Purchases Are Final

In-app purchases are non-refundable except where required by law. Once you unlock premium features, the purchase is complete.

If something goes wrong (like you paid but didn't get access), contact us at hi@easyberry.io or Apple Support, and we'll help fix it.

How Premium Features Evolve

We're committed to making MoveBrush better with every update. As part of that:

• Premium features may evolve over time. We might improve how brushes work, adjust animations, add new capabilities, or occasionally retire features that aren't working well. These updates are how we improve the app based on user feedback.
• Updates might affect how past projects look. When we refine brush physics or rendering, it can change how existing artwork appears or behaves. We work hard to maintain compatibility, but perfect backward compatibility isn't always possible as the app evolves.
• Save finished work as videos. If you create something you love, export it as a video to preserve it exactly as it is. This way you'll always have that version, no matter what changes in future updates.

By purchasing premium features, you're supporting ongoing development and you understand that the app will continue to improve and change over time.

Using Premium on Multiple Devices

Your premium purchase is tied to your Apple ID. You can use premium features on all your devices signed in with the same Apple ID. If you use Apple Family Sharing, your family members may also get access according to Apple's policies.

5. Protecting Your Work

Back up your iPad regularly through iCloud or your computer. While MoveBrush is designed to be stable, all software can experience unexpected issues—crashes, compatibility problems with new iOS versions, or other technical problems.

Your artwork is stored locally on your device. This means:

• We can't access it or recover it if something goes wrong
• If your device is lost, damaged, or reset, your work goes with it
• Regular device backups are your best protection

For important projects, export them as videos right away. This gives you a permanent copy that's safe no matter what happens to the app or your device.

6. How MoveBrush Is Provided

"As Is" Basis

MoveBrush is provided "as is" and "as available." We work hard to make it stable and enjoyable, but we can't make guarantees about software. Here's what that means:

We don't promise:

• The app will meet all your expectations or creative needs
• It will work perfectly 100% of the time
• It's compatible with every iPad model or iOS version
• Updates won't introduce unexpected issues
• Video exports will always render perfectly

No implied warranties: To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Software is complex and MoveBrush is actively developed. Bugs happen, iOS updates can cause compatibility issues, and different devices may behave differently. We test thoroughly and fix issues quickly, but we can't promise perfection.

Your local consumer protections still apply. Some places don't allow complete warranty disclaimers. If you have non-waivable consumer rights under local law, you keep those rights.

7. Limitation of Liability

Here's the important part: To the extent the law allows, Easyberry LLC and its team are not liable for indirect, incidental, special, consequential, or punitive damages from your use of MoveBrush.

This includes things like:

• Lost work or artwork due to crashes or bugs
• Failed video exports
• Time spent on projects affected by software issues
• Problems with your device related to the app
• Cost of substitute products or services

Our maximum liability is limited to what you paid us in the past 12 months. For free users, that's $0. For premium users, that's the cost of your premium purchase.

What this means: We're a small team offering powerful creative tools at an accessible price. In exchange for that value, we can't be responsible for unlimited damages.

Your rights may vary by location. Some jurisdictions don't allow complete liability exclusions (like the EU, or for gross negligence). If your local laws provide protections we can't limit, those protections still apply.

8. You're Responsible for Your Content

If you create something with MoveBrush that causes legal problems—like infringing someone's copyright or creating illegal content—that's your responsibility, not ours.

You agree to protect us from any claims, damages, or expenses (including legal fees) that arise from:

• Content you create with the App
• Your violation of these Terms
• Your violation of anyone else's rights
• Your misuse of the App

Example: If you use MoveBrush to recreate copyrighted characters and sell them, and the copyright holder sues, you're responsible—including any costs we incur if we're pulled into the legal issue.

9. Ending Your Use of MoveBrush

We can end your license if you violate these Terms or misuse the App. We can also stop offering the App entirely if needed (though we hope that never happens).

You can stop using MoveBrush anytime by uninstalling it from your devices.

If we terminate your license because you violated these Terms, you won't get a refund. Some parts of these Terms (like intellectual property rights, disclaimers, and liability limits) continue to apply even after termination.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we'll change the "Last Updated" date at the top and post a notice if the changes are significant.

If you keep using MoveBrush after we update the Terms, that means you accept the changes. If you don't agree with the updates, please stop using the App.

11. Legal Details

What Law Applies

These Terms are governed by the laws of the State of California and U.S. federal law. If you're outside the U.S., you still keep any consumer protections your local laws provide that can't be waived.

Resolving Problems

Let's talk first. Before taking any legal action, please contact us at hi@easyberry.io. Most issues can be resolved through a friendly conversation.

Where disputes are handled: Legal actions about these Terms must be brought in California courts. You agree to jurisdiction there, though consumers in some places may have additional rights to sue locally.

No class actions: To the extent the law allows, disputes will be resolved individually, not as part of a class action. You agree not to join or start a class action against us.

Other Important Points

• Complete agreement: These Terms and our Privacy Policy are the full agreement between us about MoveBrush.
• If part is invalid: If any part of these Terms is found to be unenforceable, the rest still applies.
• Can't transfer: You can't transfer these Terms to anyone else. We can transfer them if needed (like if we're acquired).
• Apple's role: Since you downloaded MoveBrush through the App Store, Apple's Standard License Agreement also applies. These Terms work alongside Apple's terms.
